Whether a Personal Injury claim (a “tort”) exists is a matter of law. There are four elements to a “tort” claim:

If you fail to file your claim within this period of time, the statute of limitations, you will forfeit your right to pursue compensation. The two-year window begins the day you learn of your injury, not when you are actually injured. The rule allows you to take action even if your injury was not immediately apparent or was sustained over a long period of time.
